These Terms of Service (“Terms”) cover your use of wellnessafclub.com, the Wellness AF app, the Wellness AF Voice podcast, our newsletter, downloads, programs, and community spaces (together, “the Service”), operated by Wellness AF Club (“we,” “us”). By using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.
1. What the Service is
Wellness AF Club provides educational wellness, nutrition, fitness, and weight-loss information and tracking tools. It is not medical care. Our Medical Disclaimer is part of these Terms; please read it. In short: nothing here is medical advice, diagnosis, or treatment, and you should talk with a qualified healthcare professional before changing your diet, exercise, medications, supplements, or health routine.
2. Who can use it
You must be at least 18 years old to create an account or use the weight-loss features. By using the Service you confirm you meet this requirement.
3. Your account
Some features (like the Club community) require an account created with Sign in with Apple. Keep your account secure and give us accurate information. You can delete your account at any time in the app, which removes your community data. You’re responsible for activity that happens under your account.
4. Subscriptions and billing
The app offers auto-renewing subscriptions purchased through Apple’s App Store. Prices are shown before you buy. Subscriptions renew automatically until you cancel in your App Store account settings; canceling stops the next renewal but doesn’t refund the current period. Free trials convert to paid subscriptions unless canceled before the trial ends. Refunds are handled by Apple under Apple’s policies. We may change subscription pricing for future billing periods; Apple will notify you as its rules require.
5. The Club community
The Club is a space for members to support each other. Don’t post anything harassing, hateful, sexually explicit, dangerous (including content promoting disordered eating), deceptive, or unlawful, and don’t post medical advice. You can report or block other members in the app. We may remove content or suspend accounts that break these rules, at our discretion.
6. Your content
You own what you post. By posting in the Service, you give us a non-exclusive, royalty-free license to host and display that content within the Service so the features work. Delete your content or account and this license ends for that content, except where copies are needed for legal or safety reasons.
7. Our content
The lessons, curriculum, articles, podcast, brand, and design are ours or licensed to us, and are protected by copyright and trademark law. You may use them for personal, non-commercial purposes. Don’t copy, resell, redistribute, scrape, or build competing products from them.
8. Third-party data and services
The Service uses third-party data sources and services, including food and nutrition databases (such as the FatSecret Platform API and Open Food Facts), Apple services (Sign in with Apple, Apple Health, App Store billing), and AI-based estimation tools. Their data may be incomplete or inaccurate, and their services have their own terms. We aren’t responsible for third-party content or services.
9. Acceptable use
Don’t misuse the Service: no unlawful use, no attempting to break, probe, or overload our systems, no reverse engineering the app except where the law allows it, no automated scraping, and no using the Service to build a competing dataset or product.
10. Assumption of risk
Wellness, nutrition, and exercise activities carry inherent risks. You use the Service, and make health decisions, at your own risk and discretion, as described in the Medical Disclaimer.
11. Disclaimers and limitation of liability
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. To the fullest extent the law allows, Wellness AF Club and Jennifer Stanley will not be liable for indirect, incidental, special, consequential, or punitive damages, or for personal injury, health outcomes, or lost data arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Some jurisdictions don’t allow certain limitations, so parts of this section may not apply to you.
12. Ending or changing things
You can stop using the Service anytime. We may suspend or end access for accounts that violate these Terms, and we may change or discontinue features. We may update these Terms; if we make material changes, we’ll post the updated Terms here with a new effective date, and continued use means you accept them.
13. Governing law
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Tennessee.
